Warranty Terms for Fennec Watch

Fennec Corp. warrants the product, Fennec Watch One, against defects in material of or workmanship for ONE YEAR from the date of delivery. Fennec Corp. will pay standard freight costs for warranty service for THIRTY DAYS from the date of delivery.
This Warranty covers the defects resulting from defective parts, materials, or manufacturing if such defects are revealed during the period of 12 months since the date of purchase.
The product is considered defective if it fails to perform the functions as indicated in the operation manuals, technical specifications, or any other similar documents supplied with the equipment, and the failure is due to internal device characteristics.
The product will be repaired or replaced as determined solely by Fennec. All products that are replaced will become the property of Fennec. Replacement products may be new or reconditioned.
Fennec provides a limited warranty for its products only to the person or entity that originally purchased the product from Fennec or its authorized distributor or retailer.
The warranty does not cover:
  • the life of the battery;
  • normal wear and tear and aging (e.g. scratched surface; alteration of the color or material of non-metallic straps and watch body; peeling of the plating);
  • any damage on any part of the watch resulting from abnormal/abusive use, lack of care, negligence, accidents (knocks, dents, crushing, rinsing the watch in the water, broken glass, etc), incorrect use of the watch and non-observance of the user directions provided by Fennec Corp.;
  • the Fennec Watch handled by non-authorised persons (e.g. for battery replacement, services, or repairs) or which has been altered in its original condition beyond Fennec Corp.'s control;
  • software malfunctions that can be corrected by software updates.
  • products that have exceeded the warranty period.
If the customer's product is not covered under warranty, Fennec may offer repair services or discounted replacement under the customer's payment.
Obtain services
Warranty and out of warranty services should be obtained by contacting the system integrator/dealer/retailer/e-tailer/distributor where the customer purchased the product, or you can contact Fennec customer support service (support@fennec.me) to apply for warranty or out of warranty services.
It is the customer's sole responsibility to back up his/her data. Before allowing any service from Fennec or its service provider, the customer must back up the data and remove any of the customer's confidential, proprietary or personal information. Neither Fennec nor its service provider will be liable for any damage, loss and exposure of confidential or private information or data contained in any product, hardware, software or media.
LIMITATIONS OF LIABILITY
UNDER NO CIRCUMSTANCES WILL FENNEC, ITS SERVICE PROVIDER OR EITHER'S AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, (INCLUDING, BUT NOT LIMITED TO), CLAIMS FOR LOSS OF DATA, GOODWILL, INCONVENIENCE, DELAY, PROFITS, USE OF MONEY OR USE OF THE FENNEC PRODUCTS, INTERRUPTION IN USE OR AVAILABILITY OF DATA.
FENNEC'S AND THE SERVICE PROVIDER'S ENTIRE LIABILITY AND CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR CLAIMS RELATED TO OR ARISING OUT OF THESE TERMS AND CONDITIONS FOR ANY CAUSE AND DESPITE THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT, STATUTORY OR OTHERWISE, INCLUDING NEGLIGENCE AND STRICT LIABILITY, WILL NOT EXCEED THE AMOUNT OF THE PURCHASE PRICE PAID. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF CUSTOMER HAS ADVISED FENNEC OR ITS SERVICE PROVIDER OF THE POSSIBILITY OF ANY SUCH DAMAGES.
